ORDINANCE NO. 04-002, FOURTH SERIES
CITY OF NEW ULM, BROWN COUNTY, MINNESOTA
AN ORDINANCE AMENDING SECTION 6.02 OF THE CITY CODE OF THE CITY OF NEW ULM RELATIVE TO REGULATION OF GRASS, WEEDS, TREES, ETC. IN PUBLIC RIGHT OF WAY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:
SECTION I. That Subdivision 2 of Section 6.02 of the City Code of the City of New Ulm is hereby amended to read: Subd. 2. City authority. The City shall have control and supervision of planting, pruning, and removing shrubs and trees upon, or overhanging, all public rights of way. The standards relating to such actions shall be controlled by the Boulevard, Tree and Shrub Policy adopted by the City Council, which shall be kept on file in the office of the City Engineer and which may be revised from time to time by action of the City Council upon the recommendation of the City Engineer. Property owners shall be responsible for care and maintenance of trees, grass, or other plantings on public rights-of-way adjacent to the property in accordance with that Policy. SECTION II. That Subdivision 3 of Section 6.02 of the City Code of the City of New Ulm is hereby amended to read: Subd. 3. Permit to plant, prune, or remove trees on rights-of-way. It is unlawful for any person to plant, remove, or prune above a height of 13 feet, any tree or shrub which is upon public property, including rights of way, without first obtaining from the City a permit in writing to do so. When required by state statute or rule, a state permit must also be obtained prior to performing such work. Applications for City permits shall be made to the City Engineer's office, and the City Engineer or designee shall determine whether the requested permit shall be issued or denied. All permits shall be subject to the requirements of the City's Boulevard, Tree and Shrub Policy. A permit may be issued subject to reasonable restrictions or conditions, which shall be provided to the permittee in writing at the time of issuance of the permit, and it is unlawful to violate such restrictions or conditions. SECTION III. That this ordinance shall take effect and shall be in force 30 days from and after its adoption, approval, and publication.
