NOTICE OF MORTGAGE FORECLOSURE SALE
NOTICE IS hereby given that default has occurred in the conditions of that certain mortgage dated September 11, 1990, given to secure an original principal amount of $61,800.00 executed by Robert T. Domeier and Carol B. Domeier, husband and wife, as mortgagor (s), to the United States of America, acting through the Rural Housing Service, formerly known as Farmers Home Administration, United States Department of Agriculture, Mortgagee, and duly recorded with the Office of the County Recorder of Brown County, Minnesota on September 13, 1990, as Document Number 260410. No action or proceeding has been instituted at law or otherwise to recover the debt secured by said mortgage or any part thereof: all preforeclosure notice requirements have been complied with: There is due and claimed to be due on the mortgage and the note secured thereby, including interest to the date of this Notice and including advances of $916.75 plus interest from the date of each advance to the date of this notice, the sum of ONE HUNDRED TWELVE THOUSAND SIX HUNDRED THIRTY SEVEN DOLLARS AND 64/100's ($112,637.64). Pursuant to the power of sale therein contained, said mortgage will be foreclosed and the tract of land lying and being located in the County of Brown, Minnesota, described as follows: LOT 13, EXCEPTING THE REAR 25 FEET OF SAID LOT, WHICH INCLUDES 10 FEET OF VACATED ALLEY IN BLOCK 164 NORTH OF CENTER STREET, CITY OF NEW ULM, BROWN COUNTY, MINNESOTA. will be sold by the Sheriff of Brown County at public auction on the 17th day of June, 2004, at 10:00 a.m. o'clock in the County Sheriff's office in New Ulm to pay the debt then secured by said mortgage, taxes, if any on said premises, and the costs and disbursements allowed by law, subject to redemption within Six (6) months from said date of sale. The State of Minnesota, Department of Natural Resources will receive sealed bids for furnishing all materials, labor, tools, equipment, transportation and all else necessary to make bituminous crack repairs at the Minnesota Department of Natural Resources, Southern Regional Headquarters, 261 Hwy. 15 South, New Ulm, MN 56073. Work shall include repairing all bituminous surfacing at this site. This work includes entrance road, three (3) parking lots of various sizes, and a parking/turnaround area at the maintenance shop. In accordance with Minnesota Statutes, Certified Targeted Group (T.G.) bidders will receive a 6% preference on the award of this bid. Certified Economically Disadvantaged (E.D.) bidders will receive 4% preference on the award of this bid. All T.G. or E.D. bidders must be certified by the time the bid is submitted. PUBLIC NOTICE: The Brown County Highway Department will be applying herbicide to the right-of-ways of County roads to control the growth of noxious weeds. Anyone wishing NOT to have a specific road ditch sprayed should contact the Brown County Highway Department prior to May 24, 2004 at 507-233-5700. When landowners/renters do not respond, we will assume it is acceptable to spray. The spring application is planned to begin May 24, 2004. There will also be a fall application this year. The dates of this application will be determined later this summer.
