NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that the City Council of the City of New Ulm, Brown County, Minnesota, will meet in the Council Chambers in the Public Library, 17 North Broadway on Tuesday, July 20, 2004 at 7:00 p.m. to consider a petition from Brian Tohal, on behalf of the New Ulm Economic Development Corporation, requesting the annexation of property to the City of New Ulm. The legal description of the property proposed for annexation is as follows:
That part of the Southeast Quarter of Section 13, Township 110 North, Range 31 West, Brown County, Minnesota, described as: Commencing at a concrete monument designating the East Quarter corner of Section 13; thence North 89 degrees 49 minutes 05 seconds West (Minnesota County Coordinate System of 1983, Brown County Zone), along the East-West center line of Section 13 a distance of 1,736.19 feet to the point of beiginning; thence South 37 degrees 02 minutes 38 seconds East, 1574.30 feet to a point on the northwesterly right-of-way line of North Highland Avenue according to the plat of North Highland Avenue Second Addition, on file and of record with the Brown County Recorder; thence South 40 degrees 50 minutes 59 seconds West, along said northwesterly right-of-way line, 437.76 feet; North 26 degrees 08 minutes 58 seconds West, 289.61 feet to the point of intersection with the south line of the North Half of the Southeast Quarter of Section 13; thence North 89 degrees 47 minutes 49 seconds West along said south line, 1454.49 feet to the southwest corner of the North Half of the Southeast Quarter of Section 13; thence North 00 degrees 04 minutes 40 seconds East, along the North-South center line of Section 13 a distance of 1325.48 feet to the Center of Section 13; thence South 89 degrees 49 minutes 05 seconds East, along the East-West center line of Section 13 a distance of 918.20 feet to the point of beginning. This parcel of property contains 44.18 acres, more or less. All persons in attendance will be given an opportunity to speak on this matter. It is Ordered and Notice is hereby given that on the 9th day of August 2004 at 1:30 o'clock PM, a hearing will be held in the above named Court at New Ulm, Minnesota, for the adjudication of intestacy and determination of heirship and for the appointment of Gordon Haack and Dale Haack whose addresses are 617 S. Broadway and 1923 N. Garden, respectively, New Ulm, Minnesota as personal representatives of the estate of the above named decedent in supervised administration, and any objection thereto must be filed with the Court, That, if proper, and no objections are filed, said personal representatives will be appointed to adminster the estate, to collect all assets, pay all legal debts, claims, taxes and expenses, and sell real and personal property, and do all necessary acts for the estate. Upon completion of the administration, the representatives shall file a final account for allowance and shall distribute the estate to the persons entitled as ordered by this Court, and close the estate. Notice is further given that ALL CREDITORS having claims against the estate are required to present the same to the personal representative or to the Clerk of the Court within four months after the date of this notice or said claims will be barred.
