ORDINANCE NO. 04-008, FOURTH SERIES

CITY OF NEW ULM, BROWN COUNTY, MINNESOTA

AN ORDINANCE AMENDING SECTION 5.42 OF THE CITY CODE OF THE CITY OF NEW ULM RELATIVE TO TEMPORARY ON-SALE INTOXICATING LIQUOR LICENSES.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:

SECTION I. That Section 5.42 of the City Code of the City of New Ulm is hereby amended to read: Section 5.42. Temporary on-sale intoxicating liquor license. Subdivision 1. Applicant. A temporary on-sale intoxicating liquor license may be issued to a club or charitable, religious, or non-profit organization which has been in existence for at least three years, or to a political committee registered under Minnesota Statutes, section 10A.14, or to a state university. Subd. 2. Conditions. A. An application for a temporary on-sale intoxicating liquor license shall state the exact dates and place of proposed temporary sale. The license shall not be valid for more than four consecutive days. No license shall be issued to one applicant or for one location for more than three four-day, four three-day, six two-day, or twelve one-day periods, or any combination exceeding twelve days within any twelve-month period. No more than one license shall be issued to one applicant or for one location within any 30-day period unless in connection with an event officially designated a community festival. B. The license may authorize on-sale of intoxicating liquor on premises which are not owned or permanently occupied by the licensee. C. A licensee under this section may contract with a holder of an annual on-sale intoxicating liquor license issued by any municipality for the purpose of selling and dispensing alcoholic beverages to be served at the event. D. The City Council may, but at no time shall it be under any obligation whatsoever to, grant a temporary intoxicating liquor license on premises owned or controlled by the City. Any such license may be conditioned, qualified, or restricted as the City Council sees fit. If the premises to be licensed are owned or under the control of the City, the applicant shall file with the City, prior to issuance of the license, a certificate of liability insurance coverage in the sum determined by ordinance or resolution of the City Council, naming the City as an insured during the license period. SECTION II. That this ordinance shall take effect and shall be in force 30 days from and after its adoption, approval, and publication.
