ORDINANCE NO. 03-079, THIRD SERIES

CITY OF NEW ULM, BROWN COUNTY, MINNESOTA

AN ORDINANCE AMENDING SECTION 9.04 OF THE CITY CODE OF THE CITY OF NEW ULM RELATIVE TO ZONING.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:

SECTION I. That Subdivision 2 of Section 9.04 of the City Code is hereby amended so as to amend the zoning map to include the following property changes thereto as to the use of districts pertinent to zoning in the City of New Ulm:

That portion of (a) Fraction t, (b) Outlot 68, and (c) Sublot B of Outlot 67, City of New Ulm, Brown County, Minnesota, to be platted as Lots 1, 2, 3, 4, and 5, Block One (1); Lots 1, 2, and 3, Block Two (2); and Lot 1, Block Four (4), North Ridge Addition, City of New Ulm, Brown County, Minnesota, heretofore zoned R-A (Agricultural Residence) District, is hereby redesignated and rezoned to R-1 (Single Family Residence) District.

SECTION II. That subdivision 2 of Section 9.04 of the City Code is hereby amended so as to amend the zoning map to include the following property changes thereto as to the use of districts pertinent to zoning in the City of New Ulm:

That portion of (a) Fraction t, (b) Outlot 68, and (c) Sublot B of Outlot 67, City of New Ulm, Brown County, Minnesota, to be platted as Lots 1, 2, 3 and 4, Block Three (3), North Ridge Addition, City of New Ulm, Brown County, Minnesota, heretofore zoned R-A (Agricultural Residence) District, is hereby redesignated and rezoned to R-3 (Multiple Family Residence) District.

SECTION III. That the City Engineer is hereby ordered to make the necessary alterations to the official map of the City of New Ulm to reflect this change.

SECTION IV. That this ordinance shall take effect and shall be in force 30 days from and after its adoption, approval, and publication.

ORDINANCE NO. 03-078, THIRD SERIES CITY OF NEW ULM, BROWN COUNTY, MINNESOTA AN ORDINANCE FOR ANNEXATION OF PROPERTY TO THE CITY OF NEW ULM PURSUANT TO MINNESOTA STATUTES SECTION 414.033. RECITALS WHEREAS, the City of New Ulm has received Petitions for Annexation of certain properties located in Section 13, Township 110 North, Range 31 West (Milford Township), all in Brown County, Minnesota, legally described below, from all of the owners of such land, requesting that such properties be annexed to the City of New Ulm; and WHEREAS, the subject property consists of less than 60 acres, abuts the city limits of the City of New Ulm, and is not presently served by public sewer facilities; and WHEREAS, a public hearing was held on the petition for annexation before the City Council of the City of New Ulm on June 3, 2003 after proper notice under Minnesota Statutes section 414.033, subd. 2b; and WHEREAS, the City Council of the City of New Ulm has deemed the described property to be urban or suburban in character or about to become so; and WHEREAS, it is in the best interests of the City of New Ulm and its residents that the described property be annexed to and incorporated into the city limits of the City of New Ulm pursuant to Minn. Statutes, Section 414.033; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM: SECTION I. That the following described property is hereby declared to be annexed to and incorporated into the City of New Ulm with the same force and effect as if such property had originally been part of the City of New Ulm: That part of the Southeast Quarter (SE 1/4) of Section Thirteen (13), Township One Hundred Ten (110) North, Range Thirty-one (31) West, Brown County, Minnesota, described as follows: Beginning at the Northeast Corner of Block 2, Valley Heights Addition, City of New Ulm, Brown County, Minnesota, according to a plat recorded as document number 210894; thence North 89 degrees 46 minutes 32 seconds West, an assumed bearing along the north line of said Valley Heights Addition a distance of 431.85 feet to the southerly prolongation of the easterly line of Valley Heights Second Addition according to a plat recorded as document number 226252; thence North 23 degrees 25 minutes 30 seconds West along said prolongation and said easterly line, 617.60 feet to the southeasterly line of a 3.51 acre parcel described in a deed recorded as document number 331850; thence Northeasterly along said southeasterly line on the following described courses: 1) North 40 degrees 50 minutes 59 seconds East 97.42 feet; 2) Northerly 106.55 feet along a tangential curve concave to the west having a radius of 600 feet and a central angle of 10 degrees 10 minutes 29 seconds; 3) North 59 degrees 19 minutes 30 seconds West 50.00 feet; 4) Northeasterly 280.84 feet along a nontangential curve concave to the west having a radius of 550.00 feet, a central angle of 29 degrees 15 minutes 23 seconds and a cord of North 16 degrees 02 minutes 49 seconds East 277.80 feet; thence North 87 degrees 14 minutes 54 seconds East along the south line of a 0.99 acre parcel described in a deed recorded as document number 331850 a distance of 324.15 feet; thence continuing Easterly, along said south line, 209.93 feet on a tangential curve concave to the North having a radius of 380.00 feet and a central angle of 31 degrees 39 minutes 09 seconds to the east line of said Section 13; thence South 00 degrees 08 minutes 02 seconds West along said east line 1102.51 feet to the point of beginning. This parcel of property contains 13.39 acres, more or less. SECTION II. The property described in Section I shall be designated and zoned as R-3 (Multiple Family Residence) District for purposes of use of districts pertinent to zoning. SECTION III. That the City Engineer is hereby directed to make the changes to the official map of the City of New Ulm evidencing the annexation and zoning of the property described herein in and to the City of New Ulm. SECTION IV. That a copy of this ordinance shall be filed with Minnesota Planning, the Brown County Auditor, the Brown County Recorder, the Milford Township Board, and the Secretary of State of the State of Minnesota. SECTION V. That this ordinance shall take effect and be in force upon whichever of the following events occurs later; 1 (entry into a written agreement by and between all owners of the property and the City of New Ulm with respect to development issues related to the property, and filing of the same with the Brown County Recorder; or 2 (thirty days after passage, approval and publication of this ordinance; and upon approval of said annexation by the State of Minnesota and filing of such approval as required by law.
