PETITION OF STATE OF MINNESOTA, BY CAROL MOLNAU, ITS COMMISSIONER OF TRANSPORTATION FOR THE RIGHT TO MAKE MINOR ALTERATIONS OR CHANGES IN COUNTY DITCH NO. 33 IN BROWN COUNTY
NOTICE OF HEARING
TO ALL PERSONS INTERESTED IN COUNTY DITCH NO. 33 IN BROWN COUNTY:
YOU AND EACH OF YOU, WILL PLEASE TAKE NOTICE, that the State of Minnesota, by Carol Molnau, its Commissioner of Transportation, has filed a Petition with the County Auditor of Brown County, pursuant to Minnesota Stat. 161.28 and 103E.202, praying that she be allowed to make minor alterations or changes in County Ditch No. 33. That attached to said Petition now on file with the County Auditor are plan sheets showing said minor alterations or changes petitioned for. That the portion of said County Ditch No. 33 as now located which is proposed to be changed or altered is described as follows: APPROXIMATE LOCATION AND PROPOSED CONSTRUCTION OVER BROWN COUNTY DITCH 33
S.P. 0801-29 (Trunk Highway 4)
Brown County
Located in Section 17, Township 108N, Range 32W, approximately nine miles South of Sleepy Eye, Minnesota. Inplace Bridge #6758 crossing Brown County Ditch 33 will be replaced with Bridge #08X03. Bridge #08X03 will consist of two lines of concrete box culvert (CBC), a 10'x10' CBC and an 8'x7 CBC.
That said Petition alleges that it is advantageous and desirable in the construction and maintenance of Trunk Highway No. 4 that said minor alterations or changes be made, and that said minor alterations or changes petitioned for will not affect the functioning nor impair the efficiency of said Brown County Ditch No. 33.
YOU WILL FURTHER TAKE NOTICE, that said Petition will be presented to the County Board of Brown County at the Courthouse in New Ulm, Minnesota, on the 19th day of August, 2003, at 10:00 o'clock A.M. at which time all persons interested in said ditch system may appear and be heard and present arguments for or against the granting of said Petition.

TO OBTAIN BID DOCUMENTS: Plans, specifications and all contract documents may be obtained at the office of Bolton & Menk, Inc., 140 First Avenue North, Sleepy Eye, MN, 56085, 1-507-794-5541, FAX 1-507-794-5542, by payment of $40.00 (non-refundable) for each set obtained.
A certified check or proposal bond in the amount of not less than 5 percent of the total amount bid, drawn in favor of Welcome to Our Home shall accompany each bid.
OWNER'S RIGHTS RESERVED: The Owner reserves the right to reject any or all bids and to waive any irregularities and informalities therein and to award the Contract to other than the lowest bidder if, in their discretion, the interest of the Owner would be best served thereby.
