ORDINANCE NO. 04-010, FOURTH SERIES
CITY OF NEW ULM, BROWN COUNTY, MINNESOTA
AN ORDINANCE FOR ANNEXATION OF PROPERTY TO THE CITY OF NEW ULM PURSUANT TO MINNESOTA STATUTES SECTION 414.033.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM:
RECITALS
WHEREAS, the City of New Ulm has received a Petition for Annexation of certain properties located in Section 13, Township 110 North, Range 31 West (Milford Township), all in Brown County, Minnesota, legally described below, from the owners of such land, requesting that such properties be annexed to the City of New Ulm; and WHEREAS, the subject property consists of less than 60 acres, abuts the city limits of the City of New Ulm, and is not presently served by public sewer facilities; and WHEREAS, a public hearing was held on the peition for annexation before the City Council of the City of New Ulm on July 20, 2004 after proper notice under Minnesota Statutes section 414.033, subd. 2b; and WHEREAS, the Planning Commission has determined that the subject property is best zoned I-1 (Planned Industrial District) upon its annexation and the City Council concurs in this determination; and WHEREAS, the City Council of the City of New Ulm has deemed the described property to be urban or suburban in character or about to become so; and WHEREAS, it is in the best interests of the City of New Ulm and its residents that the described property be annexed to and incorporated into the city limits of the City of New Ulm pursuant to Minn. Statutes, Section 414.033; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW ULM: SECTION I. That the property described on the attached "Exhibit A" is hereby declared to be annexed to and incorporated into the City of New Ulm with the same force and effect as if such property had originally been part of the City of New Ulm: EXHIBIT A That part of the South Half of the Southeast Quarter of Section 13, Township 110 North Range 31 West, Brown County, Minnesota, described as: Commencing at a concrete monument designating the East Quarter corner of Section 13; thence North 89 degrees 49 minutes 05 seconds West, (Minnesota County Coordinate System of 1983, Brown County Zone), along the East-West center line of Section 13 a distance of 1736.19 feet to the point of beginning; thence South 37 degrees 02 minutes 38 seconds East, 1574.30 feet to a point on the northwesterly right-of-way line of North Highland Avenue according to the plat of North Highland Avenue Second Addition, on file and of record with the Brown County Recorder; thence South 40 degrees 50 minutes 59 seconds West, along said northwesterly right-of-way line, 437.76 feet; North 26 degrees 08 minutes 58 seconds West, 289.61 feet to the point of intersection with the south line of the North Half of the Southeast Quarter of Section 13; thence North 89 degrees 47 minutes 49 seconds West, along said south line, 1454.49 feet to the southwest corner of the North Half of the Southeast Quarter of Section 13; thence North 00 degrees 04 minutes 40 seconds East, along the North-South center line of Section 13 a distance of 1325.48 feet to the Center of Section 13; thence South 89 degrees 49 minutes 05 seconds East, along the East-West center line of Section 13 a distance of 918.20 feet to the point of beginning. This parcel of property contains 44.18 acres, more or less. SECTION II. That the property described in Section I shall be designated and zoned as I-1 (Planned Industrial) District for purposes of use of districts pertinent to zoning. SECTION III. That the City Engineer is hereby directed to make the changes to the official map of the City of New Ulm evidencing the annexation and zoning of the property described herein in and to the City of New Ulm. SECTION IV. That a copy of this ordinance shall be filed with Minnesota Municipal Boundary Adjustments, the Brown County Auditor, the Brown County Recorder, the Milford Township Board, and the Secretary of State of the State of Minnesota. SECTION V. That this ordinance shall take effect and be in force thirty days after passage, approval and publication of this ordinance and upon approval of said annexation by the State of Minnesota and filing of such approval as required by law.
