Advertisement for Bids

Sealed bids will be received at the Office of the Finance Director/City Clerk-Treasurer, Municipal Building, located at 100 North Broadway, New Ulm, Minnesota 56073 prior to the 10:00 A.M. bid opening on Thursday, the 2nd day of October, 2003. The City will publicly open and read all bids received by the Finance Director/City Clerk-Treasurer immediately thereafter for the furnishing of all labor, tools, equipment, materials and every other article or thing necessary for the complete construction of the following improvement, to-wit:

NEW ULM RECREATIONAL TRAIL

S.P. 148-090-01; Minn. Proj. No. TEAX 0801(144)

Multi-use Trail Construction, Grade, Aggregate Base, Bituminous Surface

All bids must be sealed and marked "New Ulm Recreational Trail" and each and every proposal must be accompanied by a certified check, cash deposit, or bidder's bond for not less than five percent (5%) of the amount of such bid, payable to the City, to be forfeited to the City in case the successful bidder fails to enter into contract and to furnish satisfactory bond within ten (10) days after acceptance of such bid. The bid will remain subject to acceptance for 45 days after the day of bid opening. The City reserves the right to reject any and all bids and to waive any irregularities and informalities therein.

Description of Work: The work consists of the construction of a 4.9 mile recreational trail including the following approximate quantities: 24,259 c.y. common excavation; 13,603 c.y. select granular borrow (cv); 13,000 tons aggregate base class 5; 3,880 ton type MV 4 wearing course mixture (b); 4,330 s.f. 5" concrete walk; 4,125 s.f. 6" concrete walk and 6,690 l.f. silt fence type preassembled.

To Obtain Bid Documents: The plans and specifications prepared by the City Engineer are on file and may be examined at the City Engineer Office. Copies of the plans (11"x17"), specifications and all contract documents may be obtained at the Office of the City Engineer, 100 North Broadway, New Ulm, Minnesota 56073 by payment of $40.00 (non-refundable) for each set obtained.

Minimum wage rates to be paid by the Contractors have been predetermined and are subject to the Work Hours Act of 1962, P.L. 87-581 and implementing regulations.

READ CAREFULLY THE WAGE SCALES AND DIVISION A OF THE SPECIAL PROVISIONS AS THEY AFFECT THIS/THESE PROJECT/PROJECTS

The Minnesota Department of Transportation hereby notifies all bidders:

in accordance with Title VI of the Civil Rights Act of 1964 (Act), as amended and Title 49, Code of Federal Regulations, Subtitle A Part 21, Non-discrimination in Federally-assisted programs of the Department of Transportation, it will affirmatively assure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded maximum opportunity to participate and/or to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, disability, age, religion, sex or national origin in consideration for an award; in accordance with Title VI of the Civil Rights Act of 1964 as amended, and Title 23, Code of Federal Regulations, Part 230 Subpart A-Equal Employment Opportunity on Federal and Federal-aid Construction Contracts (including supportive services), it will affirmatively assure increased participation of minority groups and disadvantaged persons and women in all phases of the highway construction industry, and that on any project constructed pursuant to this advertisement equal employment opportunity will be provided to all persons without regard to their race, color, disability, age, religion, sex or national origin;

The following notice from the Minnesota Department of Human Rights applies to all contractors:

"It is hereby agreed between the parties that Minnesota Statute, section 363.073 and Minnesota Rules, parts 5000.3400 to 5000.3600 are incorporated into any contract between these parties based on this specification or any modification of it. A copy of Minnesota Statute 363.073 and Minnesota Rules, parts 5000.3400 to 5000.3600 is available upon request from the contracting agency."

"It is hereby agreed between the parties that this agency will require affirmative action requirements be met by contractors in relations to Minnesota Statute 363.073 and Minnesota Rules 5000.3600. Failure by a contractor to implement an affirmative action plan or make a good faith effort shall result in revocation of tis certificate or revocation of the contract (Minnesota Statute 363.073, Subd. 2 and 3)."

A minimum goal of 6% Good Faith Effort to be subcontracted to Disadvanted Business Enterprises.

NOTICE OF SPECIAL MEETING

Notice is hereby given that the Township Board of Courtland Township, Nicollet County, Minnesota, will hold a special meeting at the Courtland Community Building in the City of Courtland, Minnesota, at 7:00 p.m. on September 16, 2003 to consider awarding the contract for paving the roads within Shady Brook Acres subdivision.
