NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of that certain mortgage dated October 17, 2002 executed by Michael A. Penkert and Julie D. Penkert, husband and wife, as mortgagors, to Wells Fargo Home Mortgage, Inc., a California corporation, as mortgagee, and filed for record in the Office of the County Recorder, in and for the County of Brown, Minnesota, on October 23, 2002 as Document No. 330188; the original principal amount secured by said mortgage being $119,000.00; that no action or proceeding has been instituted at law to recover the debt secured by said mortgage, or any part thereof; that there has been compliance with all pre-foreclosure notice and acceleration requirements of said mortgage, and/or applicable statutes; that there is claimed to be due upon said mortgage, including interest to the date hereof, the sum of ONE HUNDRED TWENTY-FOUR THOUSAND FOUR HUNDRED ONE and 84/100 ($124,401.84) DOLLARS and that pursuant to the power of sale therein contained, said mortgage will be foreclosed and the tract(s) of land lying and being in the County of Brown, State of Minnesota, described as follows, to wit:

A public hearing will be held by the Brown County Planning Advisory Commission on Thursday, December 11, 2003, at 9:15 AM in the Commissioners Room #204 of the Brown County Courthouse at which time you may appear if you so desire, either in person or by agent or attorney in opposition to or support of the proposed subdivision plat. A petition for a Conditional Use Permit, as applied to the property described as Outlot A of the NE4 of the SE4 of Section 28, Township 110N, Range 31W in Milford Township of Brown County has been filed by Eric Johnson. The petition has been submitted for a Conditional Use Permit for the purpose of allowing the continued use of body shop and used vehicle dealership with expansion to 25 vehicles at any one time in the A-1 Agricultural Protection Zoning District. A public hearing will be held by the Brown County Planning Commission on Thursday, December 11, 2003 at 9:00 AM in the Commissioners Room 204 of the Brown County Courthouse, New Ulm, Minnesota at which time you may appear if you so desire, either in person or by agent or attorney, in opposition to or support of the proposed Conditional Use Permit.
