Notice is hereby given to qualified voters of Milford Township, Brown County, State of Minnesota, that filing for town office will be held for a two week period beginning December 31, 2002. Affidavits of Candidacy shall be filed with the Town Clerk at the Clerk's office, 27332 187th Avenue, New Ulm, between the hours of 10a.m. to 5p.m. December 31, 2002 to January 14, 2003. Filing will close on January 14, 2003 at 5:00p.m. Filing fee-$2.00

Offices to be filled at the March Annual Elections are: for one Supervisor (3 year term) and for Treasurer (2 year term)

NOTICE OF HEARING ON PROPOSED ASSESSMENT

TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN that the Council will meet on December 17, 2002, at 7:30 p.m., in the Council Chambers in the New Ulm Public Library in the City of New Ulm, Minnesota, to pass upon the proposed assessment prepared by the City Manager to defray the cost of the following improvements: 2001 Weed Removal Charges Lots 10-14, Block 89 South of Center Street; and Lot 5, Block 3 South of Center Street The proposed assessment rolls are on file for public inspection at the City Clerk-Treasurer's office. The following is a summary of the costs of these improvements: 2001 Weed Removal Charges Total Cost $342.46 Amount Proposed To Be Assessed $342.46 Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a signed, written objection is filed with the Finance Director/City Clerk-Treasurer prior to the hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon further notice to the affected property owners as it deems advisable. If an assessment is contested or there is an adjourned hearing, the following procedure will be followed: 1. The City will present its case first by calling witnesses who may tesify by narrative or by examination, and by the introduction of exhibits. After each witness has testified, the contesting party will be allowed to ask questions. This procedure will be repeated with each witness until neither side has further questions. 2. After the City has presented all its evidence, the objector may call witnesses or present such testimony as the objector desires. The same procedure for questioning of the City's witnesses will be followed with the objector's witnesses. 3. The objector may be represented by legal counsel. 4. Minnesota rules of evidence will not be strictly applied; however, they may be considered and argued to the Council as to the weight of items of evidence or testimony presented to the Council. 5. The entire proceedings will be tape recorded. 6. At the close of presentation of evidence, the objector may make a final presentation to the Council based on the evidence and the law. No new evidence may be presented at this point. An owner may appeal an assessment to district court pursuant to Minnesota Stautues Section 429.081 by serving notice of the appeal upon the Mayor or Finance Director/Clerk-Treasurer of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Finance Director/Clerk-Treasurer. Under Minnesota Statutes, Sections 435.193 to 435-195. the Council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. When deferment of the special assessment has been granted and is terminated for any reason provided be law, all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law and City Code Section 2.80 adopted under it may, within 30 days of the confirmation of the assessment, apply to the Finance Director/City Clerk-Treasurer on such forms as are prescribed by the County Auditor for such deferral of payment of this special assessment on his property. NOTICE OF HEARING ON FINAL SPECIAL ASSESSMENT ROLL

NOTICE IS HEREBY given that the City Council will meet on Tuesday, December 17, 2002, at 7:30p.m. at the Council Chambers in the New Ulm Public Library in the City of New Ulm, Minnesota, to pass upon the final special assessment prepared by the City Manager to defray the cost of the following improvements:

FINAL ASSESSMENT ROLL FOR THE

2002 UTILITY, STREET & ALLEY IMPROVEMENTS- GROUP I

1. Westridge Road and North Highland Avenue- Aggregate base, bituminous base, concrete curb and gutter, concrete sidewalk, concrete driveway pavement, bituminous surfacing, street lighting and boulevard restoration on Westridge Road from the existing bituminous pavement at Westhills Addition west to North Highland Avenue and on North Highland Avenue from Westridge Road to Highway 14;

2. 19th North Street- Miscellaneous removals, grading, aggregate base, concrete curb and gutter, bituminous pavement, concrete sidewalks and driveways, street lighting, and storm sewer modification on 19th North Street from North Broadway to Front Street, including extension of sanitary sewer main, water main and sewer and water end services from Minnesota Street to 320 feet west;

3. Franklin Street and 11th South Street- Sanitary sewer main/trunk line replacement on Franklin Street from 17th South Street to 11th South Street and on 11th South Street between Franklin and Jefferson Streets, water main replacement on Franklin Street from 10th South to 12th South Street and reconstruction of the existing roadway section including pavement edge drains, excavation and replacement of subgrade, sanitary sewer end service replacement as requested, granular base, bituminous paving and selective replacement of concrete curb and gutter and sidewalk on Franklin Street from 17th South Street to 10th South Street and on 11th South Street between Franklin and Jefferson Streets;

4. Bridge Street- Subgrade excavation, grading, storm sewer, sanitary sewer and water end services as requested, aggregate base, concrete curb and gutter, bituminous pavement, concrete sidewalks and driveways, street lighting and restoration on Bridge Street from Tower Road to T.H. #15 (South Broadway);

5. Doris Drive- Grading, aggregate base, bituminous base, concrete curb and gutter, concrete sidewalk, concrete driveway pavement, bituminous surfacing and boulevard restoration on Doris Drive from the KC Road to 365 feet south in Hoffman's Second and Third Additions;

6. Alleys- Grading, aggregate base, bituminous surfacing and storm sewer as needed in two (2) residential alleys:

a. Alley in Valley 1st Addtion; and

b. Alley Block 7 South of Center Street;

7. North State Street- Reconstruction of the existing roadway section, excavation and replacement of subgrade, granular base, bituminous paving, removal and replacement of the existing concrete curb and gutter, reconstruction of the obsolete series street lighting system, sidewalk pedestrian ramps at intersections, removal and replacement of concrete sidewalk and concrete driveways as needed or requested, sanitary sewer and water end service replacement as requested or needed and boulevard restoration on State Street from 8th North Street to 10th North Street;

8. 13th South Street- Reconstruction of existing roadway section including excavation and replacement of subgrade, granular base and bituminous paving on 13th South Street from Minnesota Street to Broadway;

9. Sidewalk Improvements- Construct the uncompleted four inch (4") concrete sidewalk on 16th North Street from Broadway to Minnesota Street; and

10. Fairgrounds- Regrade, gravel and bituminous surfacing of approximately 1,100 linear feet of the existing north/south service road located in the Fairgrounds area beginning at 12th North Street.

The proposed assessment rolls are on file for public inspection at the City Clerk-Treasurer's office. The following is a summary of the costs of these improvements:
